Is it legal to list someone as a reference, without permission, to acquire credit?

My husband’s ex (of 7 yrs.) & her daughter listed my husband as a reference on a car financing application. Unfortunately, the finance co. has contacted us regarding their whereabouts. We’re trying to gain more info. regarding the application, however, the finance co. is screaming “confidentiality” restraints. We’re afraid now that the ex may have done more that we don’t know about. Is there any recourse we can take?

    It is just a reference. The company is supposed to contact you to get information on the reliability of the applicant. You are in no way obligated to anything.

    Yes, she is putting down contact information. I put my mom and many things, ie doctor, mortgage, etc because she will know how to get a hold of me.

    This is not a big deal, and you shouldn’t worry about anything.

    I don’t see why not? If the person is not known to you–you say so, if you do not approve of this then tell the caller not to call again. Call the person who gave you as reference for themselves and tell them you don’t give referrals.Or you could just give a derogatory reference.

    no…you can put anyone down as a reference….but why do you want to do anything when its obvious that they must have contacted him for the reference?

    A person my list anyone as a reference without permission, however, it is up to you when the lender calls or sends you a letter requesting your reference, to decline to give them a reference. Unless you have signed something giving them a good reference, you are not liable for anything they may have done wrong. If they call you making demands, tell them to stop calling & hang up. They have no legal reason to bother you, unless you have signed something without adding: without recourse, before signing it.

    The listed reference was just so they could find her if they lost contact, which it appears they have. They are contacting the “reference” to see if you know where she it. The previous answers are correct. If you don’t know, tell them so. And it is not illegal in any way. You are only a reference (they should have checked) and are not responsible to the caller or loan in any way.

    There is nothing you can do. She can continue to list him as a reference. A reference is just someone that knows you.

    The real issue is why would anyone list someone as a credit reference without first getting their permission? To do otherwise is a great way to receive a bad credit reference.

    Are you sure this is even a reference? It sounds like (as others have already suggested) that it is simply a request for contact information. If you husband never extended credit to his ex-, he’s not a true credit reference.
